Approx 22000 medals of Defence Veterans have been deposited with the Supreme Commander between 2009 to 2012 on six different occasions. When numerous representations of the genuine demands made were ignored by the Govt with impunity; to express their anguish, the defence veterans took the step of depositing their hard earned medals.</span><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><span style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;">2. Another 10000 medals voluntarily deposited by the veterans are respectfully lying in the office of Indian Ex-Servicemen Movement (IESM) and awaiting deposit with the Supreme Commander. Earlier, the medals were accepted by the staff of the Supreme Commander in the Rashtrapati Bhavan. When no positive outcome was in sight, the veterans then decided to hand over the medals only to the Supreme Commander in person. Hon’ble Rashtrapati Jee, we wish to request you to kindly, keep the safe custody of the 22000 medals already deposited with you with honour and respect in Rashtrapati Bhavan and these be maintained properly. During Ex-Servicemen Rallies held across the country; the veterans had expressed their concern about the honour and respect of their medals lying in safe custody in the Rashtrapati Bhavan. MVC, VrC, Military cross, PVSM, AVSM PYSM AYSM, are the medals which form part of the returned medals. These medals are proudly pinned on the chest of soldiers with great pomp and show in Rashtrapati Bhavan for the exceptional bravery of soldiers in the security of nation. It should be a matter of great concern that the soldiers have decided to return these medals because of total neglect of armed forces and veterans welfare. The Central Government has announced that Prime Minister has approved the constitution of the Seventh Central Pay Commission. We Defence veterans are heartened that a separate Military Pay Commission is likely to be set up in line with the commitments made by the Government in 2009. </span><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><span style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;">2. We are however worried that this, much needed refinement would be typically hijacked in implementation, by the Civil services Bureaucracy. In fact newspaper reports (Quote TOI report dated 26 Sep 2013)--Defence ministry officials on Wednesday acknowledged that “everybody had agreed’’ that there will be no separate pay commission for the armed forces but held that the “modalities’’ on how to give representation to the armed forces in the seventh CPC would be decided at a later stage) already indicate the intention of the MOD officials to scuttle a separate Military Pay Commission. We therefore demand that: </span><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><span style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;">(a) The Military Pay Commission (MPC) be headed and staffed entirely by members serving and retired- of the Defence Forces. </span><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><span style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;">(b) Over the nearly seven decades since independence the economic status and relative standing of the Defence Forces personnel in relation to their counterparts in the Civil Services has progressively been brought down; mostly through translational anomalies introduced in issue of implementing instructions by the Civil Services personnel. To guard against this, it is suggested that the MPC be additionally tasked with the entire exercise of revision, including issue of implementing instructions consequent to the approval of the MPC recommendations.</span><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><span style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;">(c) To compensate the Defence personnel for their unusual life full of hardships and early retirement, and to make military service an attractive career, there is need to legislate that their pay would be guarded to have edge over their counterparts in Civil Services, for relative years in service, at EACH stage. The other countries of the world package their Defence personnel 15 -20 percent higher than their Civilian Counterparts.</span><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><br style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;" /><span style="background-color: white; color: #333333; font-family: 'lucida grande', tahoma, verdana, arial, sans-serif; font-size: 13px; line-height: 17px;">3. We also strongly recommend that the Chairman of MPC and CPC should be common. This will ensure that Chairman is fully in picture about the demands and requirements of both sides so that there is no discrimination. <span class="textexposedshow">I am deeply pained to circulate the email below,
received from Gp Capt VK Gandhi, Secretary General IESM.</span><br />
<br />
<span class="textexposedshow">However, the action taken by the IESM Governing
Body is correct and it should have been taken long time ago.</span><br />
<span class="textexposedshow">Governing Body IESM continued to persuade Lt Gen
Kadyan to mend his ways but, due to his ulterior motives and some carrot
hanging somewhere, he continued on the course adopted by him to destroy IESM.</span><br />
<br />
<span class="textexposedshow">Five years ago Lt Gen Raj Kadyan and Maj Gen Satbir
Singh with increasingly very large support from ESM located from North to South
of India from East to West of India, started IESM with great josh and efforts.
Rightly, within six months of its raising IESM became a force to reckon.</span><br />
<br />
<span class="textexposedshow">While many other ESM organisation have been working
hard and are still working hard to resolve problems of ESM and families, but
the approach adopted by IESM made greater success in a short time.</span><br />
<br />
<span class="textexposedshow">The UPA Government became visibly scared of the
ways of operations of IESM. Many requests, directly and indirectly came to IESM
saying don’t do this or that – IESM carried on fearlessly.</span><br />
<br />
<span class="textexposedshow">UPA Government has been looking for ways and means
to destroy IESM as it destroyed many other movements. IESM leadership stood
firmly against such attempts till one of its stalwarts saw some very attractive
carrot hanging in front of him. This happened about two years ago.</span><br />
<br />
<span class="textexposedshow">For over two years I have been receiving very
reliable information from many sources that Kadyan has been given a specific
task to achieve. His behaviour in the IESM Governing Meetings was also
confirming those inputs. I warned many senior members of IESM about it – but
they would not believe me.</span><br />
<br />
<span class="textexposedshow">The true colours of Lt Gen Raj Kadyan became
apparent to the Governing Body IESM in Dec 2012. The story beyond Dec 2012 has
been well related by Gp Capt Gandhi in his email below.</span><br />
<br />
<span class="textexposedshow">Kadyan is playing very dirty trick of creating a
divide among the officers, JCOs and OR among the ESM and families with a view
to destroy their joint power to fight against injustice by the UPA Government and
thus quickly reach the carrot hanging in front of him.</span><br />
<br />
<span class="textexposedshow">I am very sure that with the expulsion of Lt Gen
Kadyan major hurdles in the way of IESM are out. IESM have the will power and
resources and with help from you all – IESM will be able to come over the
hurdles that Kadyan will now openly generate to ensure that he receives the
carrot promised to him by highly placed personalities.</span><br />

India.</span><br />

<span class="textexposedshow">By now you must be aware that all is not well in
IESM. It is my duty to keep facts in front of all members so that members can
make their own opinion. At the outset I ask for your patience for a bit long
mail but I cannot help since I want to bring all facts in-front of veterans</span><br />
<br />
<span class="textexposedshow">IESM has been in operation since last five years.
The accounts of IESM had been regularly audited and presented to all veterans
every year in AGM. All queries raised by veterans are answered satisfactorily.
Lt Gen Raj Kadyan had been signing the balance sheet for the last five years
and had never raised any objection. Monthly income and expenditure statements
are being made as per rules and are available in the office for all to check.
Lt Gen Raj Kadyan had access to all accounts as all other members of GB and all
members of IESM. GB IESM invites all veterans to come and check the accounts
which are available in the office. GB had not agreed to put the accounts on the
website as demanded by Lt Gen Raj Kadyan as GB felt that Internet is not a safe
medium such sensitive information. Any constructive suggestion would be taken
and incorporated in the accounting procedure. Yes IESM Gov Body had refused to
pay the transportation charges of veterans who came from Jhajjhar for casting
their votes and attending the AGM on 2 Dec 2012, as it is against the rules of
the AGM and elections. This has probably infuriated Lt Gen Raj Kadyan because
he had to pay Rs 18000/ from his pocket to these veterans who were called by
him to vote for him and his candidates. Accounts of IESM are being kept as per
rules and will be projected for scrutiny of all members in coming AGM planned
on 20 Oct 2013 at AVCC Sector 37 Noida.</span><br />
<br />
<span class="textexposedshow">The problem in IESM started about two years back
when members of GB pointed out to the Lt Gen Raj Kadyan that he had been
visiting Defense Minister all alone and then issuing Sitreps to the
environment. GB members advised Lt Gen Raj Kadyan on many occasions that it
must be delegation of IESM who should meet the RM and other officials to present
the problems of veterans. Lt Gen Raj Kadyan refused this simple request and
termed those meeting as his personal meetings and confirmed that he meets RM
for many problems and also discusses the IESM issues and he would continue
meeting him alone. We all know the outcome of these meetings! I can say with
conviction that veterans and widows were not benefited in any way. But he
continued visiting RM by himself and kept mentioning it in Sitreps. This issue
was considered too insignificant to bring to the notice of environment. However
GB members communicated their opposition to the stand of Lt Gen Kadyan.
Veterans noticed the slant towards praise of the Govt in Sitreps in last few
months and discussed with GB members. Many veterans expressed their apprehensions
that this change in the outlook of Sitreps is not a healthy sign for our fight
for Justice and OROP.</span><br />
<br />
<span class="textexposedshow">GB members had been discussing in meetings that
IESM delegation must meet three the chiefs of armed forces and explain to them
problems of veterans so that Armed Force HQs understand our problems and
veterans would know the stand of HQs on veterans’ issues. Lt Gen Kadyan kept
steam rolling this suggestion and refused to meet the three Chiefs. Then,
suddenly one day he informed the GB that he had met the CNS. GB members
questioned about this visit and asked why did he visit CNS alone? He had no
reply and gave flimsy reasons that there was no time to inform any GB member.</span><br />
<br />
<span class="textexposedshow">Sometimes in April 12 Army HQs informed Maj Gen
Satbir Singh, Vice Chairman IESM, that a rally of veterans has been organized
in village Palra in Jhajjhar dist on 16 May 12. COAS Gen VK Singh would address
the veterans in the rally. The issue was discussed by the GB and a decision was
taken that IESM will wholeheartedly only take part in the rally and would
ensure a very large gathering for the rally. To the utter surprise of GB, Lt
Gen Kadyan vehemently opposed participation of IESM and veterans in the rally.
GB members over-ruled (single dissention) his objection and decided that IESM will
lend full support to the rally as this rally would bring many- fold advantages
to the veterans. Veterans would get a chance to meet COAS and explain their
problems first hand and, veterans would get to sort out their pension problems
and ECHS problems as Army HQs had arranged all specialists to attend to the
problems of veterans, Lt Gen Raj Kadyan continued opposing IESM participation
and even published in newspapers and asked veterans to boycott the rally. Lt
Gen Kadyan even gave statements against the then COAS Gen VK Singh that he was
using this rally to build up his image. This statement of Lt Gen Kadyan against
Gen VK Singh was shocking and to say the least vey shameful. He went a step
ahead and threatened GB members that he would not sanction any funds for the
rally. It was surprising to hear this from the Chairman. IESM did not spend any
funds on this rally. The rally was a huge success and veterans were a happy lot
to mingle with the brother soldiers and felt elated. Many veterans could
resolve their pension problems as CDA officials were present to provide instant
replies. On the day of the rally, Lt Gen Raj Kadyan suddenly decided to attend
the rally and insisted that he would speak on behalf of IESM. Army authorities
had by then sensed the real intent of Lt Gen Raj Kadyan that he would use his
position and create disturbance in the rally. He was not permit him to speak.
Later on it was revealed that intelligence inputs had indicated that Lt Gen Raj
Kadyan came to malign the rally and speak against the then COAS Gen VK Singh.
It was not difficult to put the two and two together of his real intent. Lt Gen
Raj Kadyan was well known to speak against Gen VK Singh in every TV interview
and used all his vocabulary to speak against Gen VK Singh. He was using his
position to make a constituency for himself and make his image on the TV shows.</span><span class="apple-converted-space"> </span><br />
<br />
<span class="textexposedshow">GB members smelled the rat and advised Lt Gen Raj
Kadyan to avoid misusing his position but he did not heed to the advice. Even
the 'MOA' of IESM clearly lays down that decision in the GB meetings will be
taken by 'Majority' view. Lt Gen Raj Kadyan continued disregarding the majority
decision of the GB. Many a times it was pointed out in GB meeting and decision
taken by GB was recorded that decision taken by GB would be final and all must
abide by the decision. His continuous disregard and willful defiance of GB
decisions had started troubling GB members.</span><br />
<br />
<span class="textexposedshow">IESM announced a grand rally on 1 Dec 2012 and AGM
and election to GB on 2 December 12. The rally was attended by more than 5000
veterans from 14 states. Many speakers expressed their views. Vice Chairman spoke
about the achievements and future plans of IESM. It was surprising to hear
Chairman Lt Gen Raj Kadyan speak against the official thinking of the IESM to
the audience. The issues brought out by Lt Gen Raj Kadyan surprised all and
brought out the differences in the GB in open. Surprisingly Lt Gen Raj Kadyan
did not deem it necessary to discuss the issues with GB members before bringing
it out in public glare thus lowering the image of IESM in the eyes of veterans.</span><br />
<br />
<span class="textexposedshow">Brig OP Marwaha and Col VK Sekhri were requested to
conduct the election of IESM GB planned for 2 Dec 12. The team had conducted
the previous elections of IESM in 2010 and were regarded very fair in
conducting elections. 24 nomination papers were received by the election team
(Five for the appointments in GB and 19 for the post of member GB). Election
team found mistakes in many forms and approved only 11 nomination forms for the
post of member GB. Lt Gen Raj Kadyan met Chief election Officer and attempted
to influence him in favor of four contestants. Chief Election Officer confirmed
to him that he would conduct the elections as per rules of Election Commission
and prevalent traditions. The results were announced as the approved nomination
papers were less than the vacancies in the GB. Lt Gen Raj Kadyan announced to
the audience that he was not in agreement with the elections and he suggested
re-elections thus creating disturbance in the meeting. He also once again
touched upon the issues which had till then not been discussed in the GB. Lt Gen
Kadyan thus once again brought the differences in the GB to the public without
even discussing in the GB. Four contestants whose nomination papers were
rejected by the Chief Election Officer then sent representation to the
Registrar Societies, Haryana Chandigarh. The Registrar Societies had fixed 4
Apr 13 as date of hearing. Chairman Lt Gen Raj Kadyan and Gen Sec Gp Capt VK
Gandhi were respondents in the complaint. Governing Body IESM took a decision
that the IESM would be represented by Maj Gen AJB Jaini, Gp Capt VK Gandhi and
Cdr SS Ahuja and no other member will attend the hearing on 4 Apr 13 from IESM.
This decision was communicated to Lt Gen Raj Kadyan who had not attended the
meeting in which this decision was taken. He not only attended the hearing, against
the resolution of GB, but also argued in favor of the petitioners. This action
on part of Lt Gen Raj Kadyan brought in open his plan to induct some members
who would take his side in GB meetings and he would be able to get his views
through the GB. This is for the information of veterans that Gov Body had
sensed a tilt in favor of Govt in the behavior of Lt Gen Raj Kadyan. GB members
were therefore very critical of his suggestions and most of his suggestions
were over-ruled with only one vote in favor of his suggestion and rest voting
against his opinion. This is probably the reason that Lt Gen Kadyan wanted to
fill the GB with his YES men but failed because of mistakes on the part of his
men in filling the forms. Director Societies in his order has asked IESM to
amend the MOA and increase strength of GB members from present 17 to 21 with a
view to accommodate the four complainants. IESM has already formed a committee
to amend the MOA and is planning to bring the amendments in the forthcoming
AGM.</span><span class="apple-converted-space"> </span><br />
<br />
<span class="textexposedshow">Lt Gen Kadyan has now called for Emergency General
Meeting (EGM) on 28 July 13 without discussing the matter in the GB. There is
no provision in the MOA of the IESM for Chairman to call for an EGM. IESM had
already planned the AGM on 20 Oct 13 and is in the process of announcing to the
environment. It is therefore difficult to understand the urgency of the EGM
when regular AGM has already been planned on 20 Oct unless there is an ulterior
motive of forcibly taking over control of GB. It is not difficult to notice the
powers working behind this move. IESM has become a thorn in the eyes of Govt
because Govt has not done justice with the veterans. This is the only to put
brakes on the activities of IESM. Therefore, this meeting has been declared
illegal by IESM.</span><br />
<br />
<span class="textexposedshow">In view of constant defiance of GB decisions by Lt
Gen Kadyan, and specially attending the hearing in the office of The Registrar
Societies on 4 April 13 totally against the resolution of GB, Lt Gen Raj Kadyan
was asked in writing on 25 April the reasons for his defiance of GB decision
and asked to reply by 1 May 13. He replied that he would send his reply by 7
May 13. His reply was not received by the due date. He was then issued a Show
Cause Notice on 15 July and was asked to send his justification latest by 25
July 13. Once again the reply has not been received by the due date. In-spite
of coming clean and giving justification of his anti IESM action, he has
decided to confront the GB and MOA and has announced an EGM with the help of
disgruntled veterans. He is also attempting to create a rift in officers, JCOs
and ORs where in-fact there is none. There is one important question which
every veteran is asking, “How much veterans have befitted from his friendship
with the Defence Minister? The answer probably is that NIL. Pension of widows
also could not be increased with his clout.</span><span class="apple-converted-space"> </span><br />
<br />
<span class="textexposedshow">Governing Body of IESM met on 25 July 13 and
deliberated on this situation and came to the conclusion that Lt Gen Raj Kadyan
has no justification for his action against the collective will of GB. He has
been constantly acting against the majority decision of GB. Because of constant
defiance of GB and lowering the image of IESM by Lt Gen Raj Kadyan, his primary
membership of IESM has been terminated by the GB under the powers vested in GB
under clause 7 (d) (vi) of MOA. His primary membership of IESM has been
terminated with immediate effect.</span><br />
<br />
<span class="textexposedshow">This is a very sad decision that primary membership
of the erstwhile Chairman had to be terminated because of his constant actions
against the majority decisions of the Governing Body and acting against the
interest of IESM.</span><br />

At a dinner gathering some days ago, I got a chance to interact with a number of politicians from different political parties. The subject of OROP being uppermost in my mind, I naturally mentioned it. Some of the comments are noted here.<br />
<br />
Mr Pratap Singh Bajwa, President of Punjab Congress Party, had a long chat with me on the subject. He promised all help. Mr Bhupender Singh Hooda, the Haryana CM, while supporting the demand also commented, “ab to aap logon ko bahut kuchh mil gaya.” He was obviously referring to the recent pension enhancement and I gave him my view that OROP is still far off. The most notable reaction came from Mr Sachin Pilot. Himself walking up to me, he enquired whether the OROP had been given. When I replied in the negative, he appeared genuinely dismayed.<br />

We have to keep garnering support whenever and whatever opportunity comes our way.<br />

Dear Veterans<br />
<br />
Indians including Veterans have a strong desire to have a party which will give us good governance but for veterans it is more important to have a Govt which will give us our status including OROP along with good Governance.<br />
<br />
It will be a big mistake to assume that only congress party is capable of providing good Governance and all other parties are incapable to provide good Governance. While some people will quote Karnataka as a failed example for BJP, we must not forget Gujrat, MP, Bihar Tamilnadu, Punjab and West Bengal which are being ruled by parties other than congress and are definitely ahead of the states which are being ruled by Congress. Large population of India is looking at Karnataka as an example that a responsible party has preferred to sacrifice a Govt but did not bow down on its principle of NO CORRUPTION AND NO COMPROMISE WITH CLEAN GOVERNANCE.<br />
<br />
Veterans, it is time to wake up and oppose UPA and its anti people and anti Military policies. We must vote for parties which will promise to meet our demands within one month of coming to power. These parties should also include veterans demands in their manifesto and loudly announce in all election meetings during campaigning.<br />
<br />
If we vote for congress, it is almost certain that this will be a vote approving all the scams and these politicians will get more deep in ruining Indian resources to fill their pockets. Well veterans vote for congress at your own peril and forget about your welfare and OROP.<br />
<br />
Congress and UPA is anti veterans and anti people and is only for bureaucrats and politicians. UPA Govt in past has denied us our dues given by the pay commissions, opposed tooth and nail our demands in courts, did not implement even after loosing in court and when gave it under the court order (to avoid contempt of court) they have declared as if they have given us OROP. Whereas truth is that they have given us nothing and are nowhere close to OROP but they are claiming to be messiah of Military and veterans.<br />
<br />
IESM is writing to all Political parties including congress to make their stand clear on the demands of veterans and confirm this through their manifesto and their election meetings. IESM will meet all parties to discuss these issues and take a firm stand. IESM will make its choice at the appropriate time just before the election time and will advise veteran community. Veterans have the right to use their vote power as they deem fit.<br />

ALL VETERANS MUST REMEMBER YOUR VOTE IS VERY IMPORTANT AND IS A PERFECT WEAPON TO GET YOUR DEMANDS ACCEPTED FROM THIS POLITICO BUREAUCRAT UNION. USE YOUR VOTE TO YOUR ADVANTAGE AND FOR A CLEAN AND GOOD GOVERNMENT. The planned IESM rally was held at Jantar Mantar On December 01. We had advertised the rally widely and great hype had been built up. Unfortunately the attendance of around 3000 was much below expectations. Thankfully, the enthusiasm of those present did overcome the lack of numbers to some extent. As a policy of gradual escalation a vehicle with medals mounted on it has been prepared and is scheduled to go around Delhi and NCR during the coming days. The vehicle was parked on site and drew great appreciation from all. There were many enthusiastic speakers that took the mike and spoke their mind on government’s repeated stonewalling our demand of OROP. Unfortunately, this upset our time schedule and we had to call off our planned march – along with the medal vehicle – on roads around Connaught Place. <br /> On 02 December was the General Body meeting and the elections. There was no voting and all the old members of the Governing Body have been returned unopposed. Colonel KK Malhotra, Hony Captains Bhim Singh and Nagender Singh are the new members of the team. The General Body reaffirmed its resolve to continue with the struggle till our demands are met. <br /> The pension enhancement coming out of the of Rs 2300 Crore that the Govt has sanctioned is expected to be announced by 15 December 2012. <br /><br /> Lt Gen Raj kadyan<br /><br /> rajkadyan8@gmail.com</div>

1. Peeved by continued apathy of the Government towards their genuine demands, the Defence Veterans plan to continue their protests across the country. As part of it, an Ex Servicemen Rally will be held at Jantar Mantar, New Delhi on 01 Dec 2012 from 10 AM to 3 PM.<u></u><u></u></div>
<div style="text-align: justify;">
2. One Rank One Pension (OROP) is a four decades old demand of Defence Veterans. It implies <b>“Defence Personnel with the same rank and same length of service must draw the same pension irrespective of the date of retirement”.</b> However despite most political parties declaring support for it, and despite many Committees on Defence recommending implementation of OROP for Defence Veterans, the Government has not implemented it. <u></u><u></u></div>
<div style="text-align: justify;">
3. Unfortunately this is not an isolated case of neglect of Defence veterans’ interests. Many Governmental actions relating to Veteran affairs indicate an institutional indifference and perhaps willful design that is both alarming and demotivating. Consider the following:<u></u><u></u></div>
<div style="text-align: justify;">
a. The ridiculous situation wherein a Major General draws a pension lower than that of a Lieutenant Colonel- three ranks lower in the hierarchy.<u></u><u></u></div>
<div style="text-align: justify;">
b. A Havildar drawing a pension less than that of a Sepoy, which is a much junior rank? <u></u><u></u></div>
<div style="text-align: justify;">
c. A Lieutenant General drawing almost the same pension as a Colonel or a Brigadier, ranks that are junior. <u></u><u></u></div>
<div style="text-align: justify;">
d. While all Central Govt employees have been given three Assured Career Progressions by the 6<sup>th</sup> CPC, the same has been <b><u>denied</u></b> to the “Sepoy” who is compulsorily retired after 15 – 17 years of service and the Assured Career progression to Defence persons are authorized after 8, 16, 24 years of service. Is it not Gross injustice that a Sepoy is not granted the financial benefit of 3<sup>rd</sup> Career Progression before retirement to enable him to get the pension accordingly? <u></u><u></u></div>
<div style="text-align: justify;">
e. Non-inclusion of Defence Services in even benefits like Non Functional Upgrades, made applicable to all other Government services EXCEPT Defence Services. <u></u><u></u></div>
<div style="text-align: justify;">
f. Widows of Defence personnel are invariably left out of accretions in Pensions announced for JCO/OR. <u></u><u></u></div>
<div style="text-align: justify;">
g. An amazing 39 serious anomalies have arisen in the implementation of even the 6<sup>th</sup> Central Pay Commission, causing grave injustice to the Defence Personnel in their status and thus inter-se equation with other Central Services, pay and pensions. <u></u><u></u></div>
<div style="text-align: justify;">
h. Non implementation of the ‘Rank Pay’ awarded holistically by the Fourth Pay Commission, despite a recent court order.<u></u><u></u></div>
<div style="text-align: justify;">
i. Periodically falsely claiming grants and benefits to Defence Veterans, without them being granted. <u></u><u></u></div>
<div style="text-align: justify;">
j. Contesting all judicial orders / rulings favoring Defence Veterans.<u></u><u></u></div>
<div style="text-align: justify;">
k. Non-inclusion of Uniformed fraternity even in committees set up over matters directly affecting them.<u></u><u></u></div>
<div style="text-align: justify;">
4. It appears that our Government does not respect the sacrifices made by a soldier-who does not think twice before making the supreme sacrifice. This is a very unfortunate state of affairs. <u></u><u></u></div>
<div style="text-align: justify;">
5. As you are aware, Defence Veterans have been depositing their medals with the President to protest the Government’s apathy towards them. 22000 medals have already been thus deposited. Following the Rally on 1 December, the next tranche’ of approximately ten thousand medals will first be taken around to various locations in NCR <a href="http://www.blogger.com/null" name="13b374f9709381e1_13b2beb5c6053f28_13b2be69802c506b__GoBac"></a>before being taken to Rashtrapati Bhawan, to make our countrymen aware of the injustice meted out to Defence Veterans.<u></u><u></u></div>

<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">1. The ex servicemen contributory health scheme (ECHS) has been in existence for a decade. While it has to an extent ameliorated the healthcare problems of defence veterans, some glaring shortcomings exist. Indian Ex Servicemen Movement (IESM) has been actively interacting with defence veterans across India to gain first hand inputs of their experience with ECHS. By now we have enough inputs about these shortcomings, which<span style="color: red;"> </span>have been brought to the notice of the Govt, the three Chiefs, AG and MD ECHS on numerous occasions. Assurances have been given a number of times for redressal of the problems but most of the cases under process which will address some of the inadequacies are still lying in various offices. If expeditious actions are taken to accord the required sanctions, the ECHS health care of its members will see a quantum improvement. Some of the issues needing immediate redressal are discussed in succeeding paragraphs.</span></div>
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Inadequacy of Funds</span></u></b><span style="font-family: "Times New Roman","serif"; font-size: 12pt;"> </span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">2. There are approx 35 lacs dependent member of ECHS. Even if Rs 27000 per member is scaled (as is presently known) the annual budget should be approx 9400 crores. As against this amount, it is understood that merely Rs 1600 crores have been planned for this year. This amount is too inadequate to service the ECHS satisfactorily. Since large numbers of polyclinics are not yet operational and a large number of ECHS members are unable to avail of the facility, and to meet the existing requirements of ECHS, there is an immediate need to bring up allocations to satisfactory levels. </span></div>
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Withdrawal of Empanelled Hospitals Due to Non Clearance of Bills</span></u></b></div>
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;"><span style="text-decoration: none;"></span></span></u></b><br /></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">3. Non availability of funds with the MD ECHS has had a cascading adverse effect on planning and execution of healthcare of ECHS members. Super Specialty Hospitals and other good hospitals are not offering themselves to be empanelled because of the non clearance of their bills in time. Suggestion was given by IESM to MD ECHS to clear 50 percent of the hospital bills within one week of receipt of the bills and remaining 50 percent be cleared within 30 days, after due evaluation, analysis and verification. We are told that such a proposal is lying with Secy DESW for a considerable time for approval. You would appreciate that delays in clearance of such important proposals adversely affect functionality.<span style="color: red;"> </span>The same needs to be sanctioned immediately to assist MD ECHS to clear outstanding hospital bills. </span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">4. A large number of good Super Specialty Hospitals initially empanelled with ECHS, have withdrawn for want of clearance of their bills and the remaining empanelled hospitals are also under financial stress and on the verge of discontinuing empanelment. Two hospitals in Ludhiana stopped accepting ECHS members. With personal intervention of MD ECHS they have restarted their service. Medanta Hospital Gurgaon, an empanelled hospital has also stopped accepting ECHS members because, out of their bills of Rs 5 crores already lying with MD ECHS, only 2 lacs and 15 thousand have been paid. All hospitals in Mysore and Nagpur had withdrawn their empanelment for nonpayment of their bills. Life of Lt Gen Raj Kadyan was saved, again with concerted efforts by IESM, MD ECHS and personal indulgence of Dr. Trehan that he was moved to Medanta hospital Gurgaon where his serious condition with 17000 platelet counts and Dengue Fever was managed effectively. Likewise two ECHS members who were to be operated for cancer at Medanta were initially refused admission but finally accepted by the hospital with personal intervention and assurance of MD ECHS for early clearance of their bills. Why should<span style="color: red;"> </span>such a situation be allowed to occur? </span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">5. The required funds need to be released well in time to ensure smooth execution ECHS. </span></div>
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Listed and Unlisted Procedures</span></u></b><span style="font-family: "Times New Roman","serif"; font-size: 12pt;"></span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">6. Medical Science has improved considerably and new procedures are introduced to improve the quality of medical care. These procedures are adopted by various super specialty hospitals. In order to provide the best available medical care to ex servicemen, there is need to review the listed/unlisted procedures at regular intervals. It is strongly recommended that any unlisted procedure which has been introduced in the country in the last six months should automatically be included in the listed procedures. This will enable the ECHS members to avail of the improved medical care. Following examples illustrate this:-</span></div>

<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">(a)<span style="font-size-adjust: none; font-stretch: normal; font: 7pt/normal "Times New Roman";"> </span></span><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Robotic surgery has been introduced in our country in many hospitals for many years. However, the same has not yet been included in the listed procedures of ECHS. Two cases of cancer patients, one with breast cancer and other with prostate cancer, who were to be operated at Medanta Super Specialty Hospital at Gurgaon (Hr), an empanelled hospital,illustrate the harassment of patients, by not implementing this. In case of both, undue delay in treatment was caused since the robotics methodology of treatment is not included in Medanta’s contract. Once Medanta has been empanelled with ECHS, all procedures and specializations being carried out there should automatically be included in the listed procedures. ECHS members should not be harassed and made to run around to get the necessary sanctions. The ECHS structure and systems should be so improved to automatically include improvements in medical science and technology. Necessary changes in the rates should be regularly incorporated by ECHS every six months. </span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">(b)<span style="font-size-adjust: none; font-stretch: normal; font: 7pt/normal "Times New Roman";"> </span></span><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Injection Avastin for eye ailment ARMD has been introduced in our country for over a decade. However, the same is not included in the listed procedures. </span></div>
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Suggested Improvement in Provision of medical Care to ESM</span></u></b><br />
<div class="MsoNormal" style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">7. Single window super specialty medical care must be made available to ECHS members. The referral to the empanelled hospital should be for consultation, investigation, treatment and follow up and there should be no need for the patient to run around to get administrative sanctions. Checks and audits may be introduced at the time of empanelling the hospital and subsequently by audit teams to ensure no malpractices are allowed to happen.</span></div>
<div class="MsoNormal" style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">8. Some suggestions are made as under:-</span></div>
<div class="MsoNormal" style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">(a) <b><u>Emergency Treatment in Civil Hospital</u></b>: The Govt. while sanctioning License/ Registration to hospitals should have a clause that defence personnel and ECHS members would be attended to in an emergency at ECHS rates. The concerned hospital should inform the closest ECHS Clinic/ECHS helpline about the patient. The designated team of doctors should visit the hospital within 24hrs to assess the condition of the patient. If the patient is in a state to be moved to an empanelled Hospital, the same may be carried out under ECHS arrangements. If he is not in a position to be moved out of the hospital, then he /she should continue to get treatment at the same hospital and the ECHS should make direct payment to the hospital at ECHS rates. If any extra charges are to be paid to the hospital, the same should be done by the ECHS and not the patient. The patient should not have to arrange and pay dues to the hospital. The case of Brig Mahajan who was, in an emergency, taken to Madanta Gurgaon by his son & was kept in ICU for more than 15 days, is illustrative. His son had to raise private loans to pay bill of Rs 5, 60,841.09 and only Rs 3, 62,882/- have been reimbursed to him. He or his son is not in a position to bear the loan amount. As per terms and conditions of service, a soldier, his/her spouse and dependents are to be given free medical care for life. <span style="background: maroon;"></span></span></div>
<div class="MsoNormal" style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;"> </span></div>
<div class="MsoNormal" style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">(b) MD ECHS should be the authority to operationalise the scheme. He can seek assistance of any military hospital nearby and other controlling authorities should be done away with.</span></div>
<div class="MsoNormal" style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;"> </span></div>
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">(c) The budget provisions for the ECHS must be made available in the beginning of the year. Additional projections may be made based on the requirement and sanctioned on Priority. </span><br />
<div class="MsoNormal" style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">(d) ECHS member should not have to spend money from his/her pocket to get any special consultation, investigation, treatment and follow up. ECHS should take care of the same.</span></div>
<div class="MsoNormal" style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;"> </span></div>
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">(e)<span style="font-size-adjust: none; font-stretch: normal; font: 7pt/normal "Times New Roman";"> </span></span><span style="font-family: "Times New Roman","serif"; font-size: 12pt;"> The facilities at military medical establishments should be made available to the ECHS members who should have a choice to go to any one of these in addition to the empanelled hospitals </span><br />
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Command and Control of ECHS</span></u></b></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">9. ECHS should function under the overall Control of AG of Integrated HQ (ARMY) and not under Secy DESW. All financial and administrative powers be vested with the AG who should be held accountable and answerable to RM & RRM through joint Chief of Staff Committee. <span style="color: red;"></span> </span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">10. All Operational Control (Adm& Financial) of ECHS should be with MD ECHS and he should be accountable to the joint Chiefs of Staff Committee integrated HQ. </span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">11. Technical support on as required basis be provided by Armed Forces Medical set up at appropriate level. </span></div>
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Obligation of Private Hospitals towards Ex Servicemen</span></u></b><span style="font-family: "Times New Roman","serif"; font-size: 12pt;"> </span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">12. Through Govt orders/institutions, it should be obligatory for any private hospital to offer themselves for ECHS empanelment. This should be incorporated in licence policy. <span style="color: red;"></span></span></div>
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Review of Authorization of Medical Specialist Medical Officer and ECHS Polyclinic Staff and their Emoluments</span></u></b><span style="font-family: "Times New Roman","serif"; font-size: 12pt;"> </span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">13. There is need to review the authorizations of Medical Specialists, medical officers and other polyclinic staff and their emoluments. The existing authorization and their emoluments are inadequate. We are told that the proposal is awaiting sanction for a long time. The same must be sanctioned expeditiously.</span></div>
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Availability of Medicines</span></u></b><span style="font-family: "Times New Roman","serif"; font-size: 12pt;"> </span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">14. Proposal to procure medicines through civil pharmacy is reportedly at final stges of implementation. same must<span style="color: red;"> </span>be sanctioned at the earliest.<b><u> </u></b></span></div>
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Enhancement of Financial Powers</span></u></b><span style="font-family: "Times New Roman","serif"; font-size: 12pt;"></span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">15. The existing financial powers at various levels are too inadequate. A proposal to enhance these powers is also awaiting sanction for a long time. The same needs to be sanctioned at the earliest.</span></div>
<div style="text-align: justify;">
<b><u><span style="font-family: "Times New Roman","serif"; font-size: 12pt;">Local Purchase of Medicines</span></u></b><span style="font-family: "Times New Roman","serif"; font-size: 12pt;"></span></div>
<div style="text-align: justify;">
<span style="font-family: "Times New Roman","serif"; font-size: 12pt;">16. All ECHS members need to be authorized to local procure NA medicine from the market and claim funds for the same. This will greatly improve availability of all prescribed medicines. </span></div>

<b><b>1. The Govt has not only not resolved 39 serious anomalies in Pay & Pension of Defence Personnel, it has not implemented the judgements of Armed Forces Tribunal & Supreme Court given in favour of Defence Personnel. Recommendations of Rajya Sabha Petition Committee on OROP strongly recommending OROP to Defence Personnel have not been implemented. </b></b><br />
<b><b></b></b><br />
<b><b>OROP issue which has been duly analysed for over 7 months by members of parliament, was assigned to a Committee of secretaries who had earlier given evidence to Rajya Sabha Committee against the grant of OROP. What could be expected from them? PM, RM and the three Chiefs were apprised of it. On 24th Sep 2012 (Evening) the Govt misled the soldiers and the Nation when they announced that OROP has been approved. Infact the approval is nowhere close to the OROP. </b></b><br />
<b><b></b></b><br />
<b><b>They have removed a serious anomaly of 6th CPC where the bureaucracy had manipulated the recommendation of 6 CPC i.e “minimum of pay of the Rank in the Pay band was changed to Minimum pay of the Pay Band”. For Sepoy to Hav, they have given two years additional weightage which means an increase of only Rs 400 per month. The demand of three Chiefs to include members from the serving and retired Defence personnel in the Committee was not accepted.</b></b><br />
<b><b></b></b><br />
<b><b>
2. Our struggle to get Justice therefore, will be continued with increased intensity. </b></b><br />
<b><b></b></b><br />
<b><b>With the above in mind, a Rally has been planned to be held at Jantar Mantar New Delhi on 01 Dec 2012 from 1030 – 1530hrs. All ESM who have not deposited their medals are requested to do so in large numbers. </b></b><br />
<b><b></b></b><br />
<b><b>Medals can be collected area wise and brought to the Rally or individual ESM may deposit their medals at the rally site.
</b></b><br />
<b><b></b></b><br />
<b><b>3. Future course of action and resolutions will be collectively passed at the Rally to ensure that we get our due Justice. </b></b><br />
<b><b></b></b><br />
<b><b>This Rally in Delhi is being held to showcase the continued apathy and mistreatment to the military and to impress upon the Government to see the writings on the wall and act fast to address all grievances of Defence personnel expeditiously.
</b></b><br />
<b><b></b></b><br />
<b><b>4. In last ten years, the Defence Forces have suffered a lot of ignomies and humiliations due to apathetic attitude of the Govt. and the bureaucracy. The government is mistaken if it thinks that by dragging its feet on the issue of the armed forces dissatisfaction with the recommendations of the Sixth Pay Commission, it can make the issue go away.</b></b><br />
<b><b></b></b><br />
<b><b>
5. A country that refuses to respect its armed forces will eventually end up getting forces that will not respect the nations' aspirations. A country makes a sacred contract with its soldiers that while he/she will lay down his/her life when called upon to do so, the nation will take good care of his/her and his/her family's needs to the extent its resources would permit.
</b></b><br />
<b><b></b></b><br />
<b><b>6. Besides the Rally schedule, it is proposed to take out a March of 3 – 4 Kms on a designated route. It is also planned to prepare a vehicle platform on which gallantry and Distinguished Service Medals number approx 10 thousand which have already been deposited with us by volunteer ESM and a large number which will be deposited on the day of the Rally will be respectfully placed in a “Show Case” separately made for the purpose. This will be placed at the Rally Site and moved along with scheduled March during the Rally. Subsequently, it is planned to move the vehicle alongwith the “Show Cased Medals” at various locations in the NCR for a period of 5 – 7 days. Four volunteer ESM will always escort the medals on the vehicle.

<b><b>7. IESM Conveners in nearby states i.e. Haryana, Rajasthan, Punjab, Himachal, Uttrakhand, UP who desire to parade the vehicle with Medals in their States may write to IESM HQ, at 543 Sector 23, Gurgaon (Haryana) on mail ID : satbirsm@gmail.com The vehicle would be planned to be dispatched to the volunteer states for a period of 3-4 days.

<b><b>8. Veterans, their family members and supporters in large numbers are requested to attend the above Rally. As hither to, part reimbursement of transport will be made by IESM. All administrative arrangements will be tied up. All ESM who have uniforms with them are requested to come in uniform, others may wear Mufti Dress with Regimental tie and cap. All those who don’t have Mufti may wear Shirt & trouser.

Hon’ble Prime Minister,
<br>
<br>
1. The fact that you have approved the constitution of a committee headed by Cabinet Secretary on issues of relevance to defence personnel both serving and retired (copy attached) shows your concern to resolve serious anomalies in their pay and pensions and grant them due justice.
<br>
<br>
2. However, we would like to bring to your notice a few of our serious concerns in this regard as under:-
<br>
<br>
(a) One Rank One Pension. When a Parliamentary Committee has already looked into the demand of One Rank One Pension (OROP) and recommended the same, would it be ethical for a committee of bureaucrats to examine the same demand? Wouldn’t this send a wrong message? Who is more important to the PM, the voice of elected representatives of a democracy or a body of career bureaucrats? In a democracy should the bureaucracy sit in judgment of the recommendations of the Parliamentary Committee reports and court judgments? It is pertinent to mention that four of the five secretaries of the newly constituted committee ie Defence, Finance, Expenditure & DESW had appeared before the Petition Committee of Parliament and had given evidence against the grant of OROP. However, the Petition Committee had totally rejected their contention and strongly recommended the grant of OROP. The defence veterans are of the view that these secretaries are likely to repeat their already known view and the outcome of the newly formed committee is a foregone conclusion as far as OROP is concerned. Action Taken Report (ATR) on the Koshiyari Report, which the Govt was required to give by 19 Mar 2012, has not yet been given. Mr Prime Minister Sir, in order to meet the ends of justice, it is strongly recommended that the issue of review of OROP by this committee be taken off from the terms of reference and OROP be granted to all defence personnel in perpetuity based on the recommendation of Rajya Sabha Petition Committee immediately.

(b) The second serious concern is regarding non-inclusion of serving and retired defence personnel as its members. You will agree that bureaucrats are perceived to have been behind the systematic down-gradation of status, pay and pensions of Defence Personnel. Otherwise, how one can explain 108 times increase in pension of senior most civilian employ from 1973 to 2006 while the pension of highest defence rank ie COAS has increased 45 times? A Sepoy is compulsorily retired after 15/17 years of service and not granted his 3rd career progression which is available to all other central govt employees. Non Functional Upgradation (NFU) is authorized to Grade A and IPS viz IAS, IFS and not authorized to Defence officers. The defence personnel feel that the main reason of injustice was that they were not represented in 6th CPC, the demand which was strongly made by all the three Chiefs and Joint Chief of Staff Committee but unfortunately not agreed to by the govt. Sir, the present composition of the committee infuses no confidence amongst the defence personnel both serving and veterans. We are of the view that 24 lakh veterans and over 3 lakh widows would not want to have another committee which may reject their most genuine demand of OROP. It is therefore, strongly felt that at least four members be included in the composition of the newly formed committee ie one each from serving Army, Air Force and Navy and one from Ex Servicemen.

<br>
7. Mr Prime Minister Sir, you are aware that together the Defence Personnel, serving and veterans, their family members and supporters have voting strength of over six crores. There are over sixty large cantonments and over 250 military stations in the country. Continued apathy and disregard of their genuine demands by the present UPA govt is likely to polarize them against it. They are also getting restless and are no longer wanting to wait for any length of time.
<br>
<br>
8. In view of the foregoing we request the following:-
<br>
<br>
(a) OROP issue be delinked from the scope of this committee. Rajya Sabha Petition Committee Recommendations strongly recommending grant of OROP be accepted and OROP in perpetuity be granted to all defence personnel immediately.
<br>
<br>
(b) For remaining issues, the composition of the committee be amended to include three members from serving defence personnel and one from Ex Servicemen.
<br>
<br>
(c) Another important issue of reduction of unacceptable large gap between pre 2006 retiree Majors and Lt Col (over Rs 14000/- per month) be included in the terms of reference of this committee.

1. We are surpresed to know that the Govt has once again constituted another Committee of six secretaries headed by the Cabinet Secretary to go into One rank one pension (OROP) and other pay and pension related issues of Defence personnel both serving and retired. Why this committee has been ordered sans all logic? The committee of these very secretaries headed by the Cabinet Secretary was ordered during the last LS Elections. Without assigning any sustainable logic and quoting old references where OROP had been denied, it had rejected the demand of OROP.
<br>
<br>
2. The Rajya Sabha Petition Committee on OROP comprising MPs from all parties heard all stake holders for over 7 months. Four out of the five secretaries of the newly constituted committee ie Defence, Finance, Expenditure and DESW were called for evidence by the Rajya Sabha Committee. They all, on frivolous reasons gave evidence against the grant of OROP. The petition committee after deliberating on all the evidence brought before it, strongly rejected the reasons put across by these four secretaries to deny the OROP and strongly recommended the grant of OROP and tabled its report in the Rajya Sabha on 19 Dec 2011.

<br>
3. It is a travesty of justice that the Govt, which, as per the existing rules and Standard Operating Procedures was required to take decision on the Petition Committee and Action Take Report ie (ATR) by the Govt was due within three months ie by 19 Mar 2012, has not done so, and instead in order to further delay, harass and finally reject OROP, once again has ordered the new committee of the same five bureaucrat secretaries. Sir what can we expect from this committee? They had already rejected OROP and gave evidence against it to the Petition Committee. It is foregone conclusion that, they will again give the same reasons and reject the OROP.
<br>
<br>
4. Mr. Prime Minister Sir, we had in our letter dated 05 July 2012 requested you to accept the Petition Committee Report on OROP and grant the same to all Defence Personnel at the earliest. We are yet to receive acknowledgement and we do not know whether the letter has been put up to you (Copy enclosed).
<br>
<br>
5. Sir, we earnestly request you to cancel the constitution of this new committee of bureaucrats, since such a committee infuses no confidence in the Defence personnel both serving and retired. We are of the view that 24 lacs veterans and over 3 lacs widows would not want to have another committee which will reject theirs most genuine demand of OROP.

6. It will be pertinent to mention that the present status of the issues which have been assigned to this committee is as under:-

<br>
(a) Non Functional Upgradation. This has already been granted to Gp A services, IPS viz IAS, IFS. It was not extended to Defence Officers for the reasons not known. The only thing known to us is that the 6th CPC had no representation from Defence Forces serving or retired. The Govt has to take a call on it and extend the same policy to the Defence officer for which no committee is required to be formed.

(b) HAG + to all Lt Gen. It is already applicable to Addl Secy, DGPs and 25% of Lt Gen and equivalent. It only needs to be extended to all Lt Gen. Again there is no need for another committee recommendation.

<br>
(c) One Rank One Pension. The petition Committee of Rajya Sabha has strongly recommended grant of OROP and rejected the reasons given by four of five secretaries of this committee to deny the OROP. The Govt has to take decision on the Petition Committee Report and inform the Parliament as Action Taken Report. Another committee of secretaries who have given their evidence against the grant of OROP will serve no purpose. Definitely, the Petition Committee of Parliament has far higher status then the Committee of Secretaries. It will be an insult of the Parliament if committee of secretaries is given higher consideration.
<br>
<br>
(d) Enhancement of Family Pension. This most needy segment of Defnece pensioners was left out when Pensions of JCOS and Ors were enhanced in Mar 2010. It was grave injustice done to them. The reasons subsequently given by the MoD to deny them the enhancement, to say the least sans all logic. RM during IESM delegation meeting had assured that this anomaly will be removed and it had the blessings of UPA chairperson. He later informed that he had cleared the file for enhancement of widows pension, however, Finance Ministry has rejected it. The matter is between RM & FM and needs no review by another committee of secretaries.
<br>
<br>
(e) Enhancement of Grade Pay of Lt Col/Col/Brig and Removal of Pay Anomalies of Other Ranks. These are the anomalies which have been in detail deliberated upon by the Service HQs and strongly recommended for sanction by the Govt. There is no need to have another review by a committee of secretaries.
<br>
<br>
7. Mr. Prime Minister Sir, you are aware that together the Defence Personnel serving and retired, their family members and supporters have voting strength of over six crores. There are over sixty large cantonments and over 250 military stations in the country. Continue apathy and disregard of their genuine demands by the present UPA govt is likely to polarize them against it. They are also getting restless and are no longer wanting to wait for any length of time.

8. May we request you earnestly to sanction OROP and other issues assigned to this committee immediately and cancel the newly constituted committee of secretaries headed by the Cabinet Secretary? If at all the Govt wants to have another opinion before taking the decision, let the Committee of the following be formed immediately to give its report by 08th Aug 2012 as per the schedule of the newly formed committee :-

Very Positive development: Finally, a time-bound committee to look into, and implement the resolution of anomalies affecting defence personnel and veterans
<br>
<BR>
The defence community would be pleased to know that the Prime Minister’s office has directed the constitution of an anomalies committee to look into many vital anomalies affecting serving and retired personnel and also their families.
<br>
<BR>
The best part of the directions signed this week is that the committee is to submit its recommendations within a month and the implementation of the accepted recommendations may also be announced on 15 August 2012, thereby marking a radical signal of positivity.
<br>
<BR>
Though a chunk of the bureaucracy in the Ministry of Defence was not inclined to let any such committee come through, this has been possible due to multiple channels of Track-II diplomacy and the stellar efforts of the Chairman COSC and the Pay Cells of the three services which evoked direct response from the Raksha Mantri who then took it upon himself to get this committee approved from the Prime Minister personally and directly without being blinded by comments of lower bureaucracy of the MoD.
<br>
<BR>
The only negative offshoot is that the committee does not have any serving or retired military member and that a proper consultative process was not initiated before identifying the anomalies which required immediate examination. Ideally, the stake-holders should have been a part of the process. The Committee shall function under the Cabinet Secretary with the Defence Secretary, Secretary Ex-Servicemen Welfare, Expenditure Secretary and one representative of PMO, as members.
<br>
<BR>
Howsoever we may view the development, many important issues such as Non-Functional Upgradation, enhancement of pensions of widows, One Rank One Pension, enhancement of Grade Pay of Lt Cols / Cols / Brigs, universalisation of scales, grant of HAG+ to all Lt Gens, removal of pay anomalies of other ranks etc have been listed in the charter of the committee. Five anomalies concerning serving personnel and four concerning veterans and pensioners shall be taken up.

It is however surprising that while the PM had directed that the constitution of the committee may be publically announced, the same has not been done by the staff at MoD till date despite the fact that the directions were conveyed by special courier (by hand) to the MoD for immediate action by the

Based on my interaction with the Defence Minister, I had earlier mentioned that he would be recommending to the PM about constitution of a committee to look at some of the pension anomalies. I received a call from the Secretary ESW today confirming that the committee has been formed. Headed by the Cabinet Secretary, it includes Secretaries ESW, Finance, Department of Personnel and another. Some of the issues the Committee would examine are:

<br>
• One rank one pension.
<br>
<br>
• Enhancement of widows’ pension.
<br>
<br>
• In case a Defence pensioner is getting two pensions, on his demise the widow too would continue receiving both pensions.
<br>
<br>
• A disabled ward would get pension throughout life and not only up to attainment of adult hood.
<br>
<br>
• Fixing of the officers’ pension based on minimum of the rank ‘in’ the pay band and not ‘of’ the pay band.
<br>
<br>
• Putting all Lt Generals in HAG + grade.
<br>
<br>
There are more issues, the details of which would be known in due course. The Committee has been given one month to complete the assigned task.
<br>
<br>
While every enhancement in pensions would be welcome, we will continue the struggle till OROP as a concept is implemented.

1. We just spoke about empanelled hospitals at Nagpur. Mail received
from veteran Ramesh Bora is enclosed.

2. There is need to get Super Specialty Hospitals empanelled to ECHS.
I looked at the list of CGHS empanelment and I found there are 36
hospitals on the list. I am enclosing the same for your information.
You may like to get approval of the Govt. for all CGHS empanelled
hospitals deemed to be empanelled to ECHS. Simultaneously, we should
either outsource the processing of Bills or introduce automation at
more locations and in due course cover the entire country. You are
aware that good super specialty hospitals are withdrawing from the
ECHS for delay in clearance of their bills.

3. In the mean time local formation i.e. HQ MAINT COMMD IAF may be
asked to play an active role in getting the local hospitals to opt for
ECHS.

Some veterans have expressed the view that time has come to take a look at veterans agitation for OROP. Veterans have expressed their concern that the holding rallies, medal returns to the President and sending memorandums to the Govt has had very little effect on the Govt.
<BR>
<BR>
While it is true that OROP has yet not been sanctioned by the Govt for the veterans, but agitations spearheaded by the IESM has given dividends in the form of increased pension for our JCOs and ORs. Full parity in pension for all is yet to be achieved. Once OROP is given to veterans all veterans would draw equal pension for same rank and same length of service.
<BR>
<BR>
I would like to confirm that agitation spearheaded by IESM has paid dividends as enumerated below OROP has been brought in center stage of the nation. Definition of OROP is now known to all. Govt which was wrongly quoting grant of OROP has now realized that it can not fool veterans by making incorrect statements on the floor of parliament.
<BR>
<BR>
Many state Govt have unanimously passed resolution supporting OROP for the veterans.
Govt is on back foot and has sent requests to IESM not to return any more medals.
Parliamentary committee on defense headed by Sh Satpal ji Maharaj and members of all parties have unanimously recommended OROP for veterans.
<BR>
<BR>
Sh Rajeev Chandrashekhar and other MsP have been raising grant of OROP in both the houses of Parliament.
<BR>
<BR>
Many parties have openly supported grant of OROP at various forums.
Rajya Sabha had ordered a committee headed by Sh Bhagat Singh Kothiari. The committee had members from all parties. This committee had heard all the section of society and the Govt view also and had recommended OROP for the veterans. The committee went a step further and negated all the reasons given by Govt. ATR by the Govt on the recommendation of this committee is still pending. IESM is making all out efforts to get this report at the earliest.
<BR>
<BR>
Presidents of opposition parties have written to PM for grant of OROP for veterans.
However despite above efforts Govt is still not inclined to grant OROP for the veterans and is taking refuge under the pretext that they would like to grant OROP in steps. This is not acceptable to veterans and IESM. IESM is inclined to do brain storming at this stage and is looking for better ideas and dynamic veterans to join in protests and agitations and even to lead them.

Request For Out of the box Solution and volunteers to Lead
There is no doubt that veterans need to step up the agitation to ensure that the Government listens and accedes to our demands. IESM believes that its views are not the last word in planning an agitation, secondly its plan is not final word and thirdly modus operandi of agitation can definitely be improved to make it more effective. This is the reason IESM has always been requesting veteran community to give practical suggestions and also take a step forward to lead the agitations in a more effective manner. IESM would be more than keen to follow the group of veterans who would like to lead the agitation with their suggested out of the box solution, and hope that the suggested solution would be more effective and would help shake the Government to accede to veterans' demands. IESM is suggesting this as it believes in brain storming and that every suggestion needs to be considered on its merits and its pros and cons discussed in detail. IESM has only one request that please do not give only solutions but take a step forward to Join/lead veterans in making the agitation more effective. TOGETHER WE CAN MOVE MOUNTAINS BUT INDIVIDUALLY WE ARE ZERO, ALL VETERANS ARE REQUESTED TO JOIN IN THIS STRUGGLE AND MAKE THE STRUGGLE MORE EFFECTIVE SO THAT THE GOVERNMENT ACCEDES TO OUR JUST AND RIGHTFUL DEMANDS.

PLEASE NOTE; IESM WOULD NOT BACK ANY SOLUTION WHICH PROPAGATES ANY INCONVENIENCE TO CITIZEN AND DAMAGE TO GOVERNMENT PROPERTY. IESM WOULD FIGHT FOR RIGHT OF VETERANS WITHIN THE LEGAL FRAMEWORK OF INDIA WOULD SUPPORT ONLY NON VIOLENT AGITATION.

Power of Unity

It is time to put more pressure on the politicians so that they accede to veterans' just demand of OROP and treat the veterans with more respect. All veterans should understand the power of unity and the effect it would have on political scene if we use it more effectively. Time has now come to forget our local leanings and local issues and to take a vow that VETERANS WOULD UNITEDLY WOULD NOT VOTE FOR THE PARTY WHICH REFUSES TO GIVE US OROP AND WHICH DOES NOT CARE FOR ITS SOLDIERS AND VETERANS. SOLDIERS PROUDLY SACRIFICE THEIR LIFE FOR THE COUNTRY SO THAT CITIZEN LEAD A LIFE OF PROSPERITY. HOW CAN WE PERMIT POLITICIANS TO LIVE A POMPOUS LIFE WHEN THEY DO NOT CARE FOR A SOLDIER/VETERAN? IT IS A WAKE UP CALL FOR ALL VETERANS TO JOIN TOGETHER AND MAKE IT A COMBINED FIGHT TO GET OUR DEMANDS.

Power of Vote

There are 23 lacs veterans 11 lac serving soldiers (total no is 34 lacs ) spread over the country. Some parts of the country have dense population of veterans and soldiers while other parts of country have very less density of veterans. Every veterans has power to influence at-least 10 votes that of his close family and friends. This means together we can influence 34*10 = 340 lacs or 3.4 crore votes. And with the proper study of distribution of the veterans and soldiers density, together veterans can influence the result of close to 40 to 45 parliamentary constituencies. It is surprising that veterans are begging the Government to give us OROP with so much of power in hand. WAKE UP SOLDIER AND USE YOUR VOTE DECISIVELY ALL OUR DEMAND WOULD BE MET BY THE POLITICAL PARTIES. LEARN ABOUT YOUR VOTE POWER AND USE IT MORE EFFECTIVELY. IT IS YOU AND YOUR VOTE WHICH WILL DECIDE THE COMPOSITION OF THE NEXT GOVERNMENT . EVERY VETERANS HAS POWER TO DECIDE HIS OWN FUTURE ONLY REQUIREMENT IS THAT VETERANS VOTE TOGETHER IN A BLOCK.

GRANT OF ONE RANK ONE PENSION TO DEFENCE VETERANS

1. This has reference of our letter dated 14.03.2012 addressed to all Members of Parliament and reply received from MoD (Pension Grievances) signed by Mr. Ajay Seth (Accounts Officer) (Copy attached).
<br>
<br>
2. We are deeply concerned at the way the welfare issues of Defence Personnel are being dealt with by the Govt. Letters to the PM are written only when all efforts to get the issues resolved have not borne results. Mr. Prime Minister Sir, we wish to inform you that we have appealed to every possible authority including your goodself a number of times on the issue. It seems that your staff does not even put up our letters to you since no reply is received which has your approval. Accounts Officers/Section Officers send the routine bureaucratic reply which does not even mention that the PM has considered and the draft of the reply has his approval.
<br>
<br>
3. One Rank One Pension (OROP) has been strongly recommended by Rajya Sabha Petition Committee and its recommendations were tabled in Rajya Sabha on 19 Dec 2011. Action Taken Report (ATR) by the Govt was due within three months ie by 18 Mar 2012 which is still awaited. The salient features of the recommendations were forwarded to all members of Parliament and others Govt functionaries. These are once again given in succeeding paras.
<br>
<br>
4. Findings and Recommendations of the Rajya Sabha Petition Committee Report on OROP:-
<br>
<br>
(a) Concept of One Rank One Pension. OROP implies that uniform pension be paid to the Armed Forces personnel retiring in the same rank with the same length of service irrespective of their date of retirement, and any future enhancement in the rates of pension be automatically passed on to past pensioners.
<br>
<br>
(b) Govt Justification to deny OROP Untenable. The Committee has not agreed with the infructuous arguments offered by the Government to deny OROP to Defense Pensioners/Family Pensioners. The committee observed that the three reasons i.e. Financial, Administrative and Legal, given by Government to deny OROP are untenable and merely a smoke screen to deny the ex-Servicemen their rightful dues. The Committee felt that such injustice to the Defence Forces is only due to bureaucratic apathy.
<br>
<br>
(c) Historic Perspective Justifies OROP. The Petition Committee observed that not only has the demand of OROP been included in the manifests of all leading political parties but it has also been repeatedly considered by all Central Pay Commission since the 3rd CPC in 1973, numerous committees like Inter Ministries Committees, Group of Ministers and Committee of Secretaries besides two Parliamentary Standing Committees on Defence of 2003 and 2010. In view of the above, the Committee felt that there is merit in the demand for OROP by Armed Forces Personnel.
<br>
<br>
(d) Bureaucratic Manipulation to Change Established Concept of Military Pensions. The Committee observed that in order to adequately compensate for the uniqueness of the armed forces as distinct from the other Govt servants, the concept of military pensions was historically better and different from that of the remaining Govt Servants. However, this was arbitrarily and without any justification changed by 3rd CPC in 1973. The Committee opined that the Govt has not been able to provide any justification for changing the established concept and reducing military pension and the decision to align military pensions with civilian pensions was an ill considered decision, which gave rise to the demand of OROP.
<br>
<br>
(e) Uniqueness of Defence Forces- No Commonality with Other Services. The Committee observed that the Govts apprehension that civilian pensioners will also demand OROP is baseless because of tougher and harsher conditions of service of the armed forces vis-à-vis the civilians and there is no commonality between the Defence Forces and other Govt services. The two cannot be equated and the armed forces deserve special dispensation.
<br>
<br>
(f) Ex Servicemen Discontent is Distressing.“The Committee is distressed to note that the defense personnel of our country have returned their service medals to the President of India because of the Governments' apathetic attitude towards them. The Committee felt that such alienation should not recur and their legitimate and fair demand of OROP be accepted.
<br>
<br>
(g) Small Financial Outlay. “The Committee noted that out of the total financial liability of Rs 1300 crores for the year 2011-12 in case OROP is implemented fully for all the defense personnel in the country, the liability for the Commissioned Officers would only be Rs 235 crores and remaining for JCOs and Other Ranks. The Committee feels that Rs 1300 crores is not a very big amount for a country of our size and economy for meeting the long pending demand of the armed forces of the country.
<br>
<br>
(h) Recommendation.
<br>
<br>
(i) “Keeping in view all the above factors, the Committee strongly
recommended that Government should implement OROP in the defense forces at the earliest”.
<br>
<br>
(ii) Applicability for Future Increases. “The Committee further recommends, for future, the pay, allowances, Pension, family pension, etc. in respect of the defense personnel should be determined by a separate commission so that their peculiar terms and Conditions of service, the nature of duties they are required to perform, etc., which are quite different from the civilian work force, are duly taken into account while taking decision on the same”.
<br>
<br>
5. This is an important demand of the Defence Forces and has been strongly recommended by almost all PMs, all political parties, three parliamentary committees on Defence. It is not understood as to why the same has not yet been accepted by the Govt? The fact that this issue remains unresolved for a long time and is still being persisted by the Defence Veterans and the three service HQs indicate the importance and genuineness of the demand. This has been duly analysed by the Rajya Sabha Petition Committee which found it totally justifiable demand and strongly recommended its sanction and implementation. The reasons so for given by the Govt and the Committee of Secretaries headed by the Cabinet Secretary to deny the OROP have also been strongly rejected by the Petition Committee. .
<br>
<br>
6. Sir, the Defence Veterans are getting restless due to total apathy and disregard being shown to them. It also adversely affects the serving defence fraternity since most of them have veteran kiths and kins and the fact that they would also be veterans in due course of time. OROP is a concept which in the form of Military pensions existed till 1973 when the 3rd Central Pay Commission clubbed the Defence Personnel with other Civilian Central Services; a decision which the Petition Committee felt was unwise. The Defence Personnel have suffered thrice over; one they were denied their system of Military Pensions, (the pension of Defence personnel were reduced while that of Civilians Counterparts were increased. The highest pension of civil servant till 1970 was Rs 416.50 Pm/- while that of Chief of the Army Staff (COAS) it was Rs 1000 Pm/. In 2006, pension for both is Rs 45000/- pm, which means while the pension of Defence highest rank has increased only 45 times, that of civilian highest rank it has increased 108 times). There is just no justification for the same. Thirdly, while Non Functional Upgrade (NFU) has been granted to Group A Central Services and IPS, the same has been denied to the Defence Officers and for other ranks, the Third Assured Career Progression (ACP) sanctioned by the 6th CPC award for all Govt employees, has been denied to the soldier Sepoy who is being compulsorily retired after 15/17 years of service. These are glaring and serious issues of injustice and need to be resolved immediately.
<br>
<br>
7. OROP is just and fair demand which must be sanctioned immediately. This affects over two million defence veterans and over three lacs widows. The IESM Governing Body is compelled to decide that incase the OROP is not sanctioned by 15 Aug 2012, the protest Movement across the country will be intensified. Sir, this decision though very painful has been forced on the Defence Veterans since concerted efforts for the last over four years have been nullified by the Govt Apathy towards the welfare of Defence Veterans.
8. We earnestly, request you for your personal indulgence and grant of OROP to the Defence Personnel immediately to stop any further alienation, demoralization and anguish to the defence fraternity.

1. ECHS was introduced with an aim to provide required suitable healthcare to the defence veterans in super specialty empanelled hospitals near to their place of residence and with smooth and comfortable procedures and also to reduce load on the military hospitals. However, in practice, due to multiplicity of authorities in operationalising the scheme, a lot of avoidable delays and cumbersome procedures have been introduced causing undue delays and harassment to the ECHS members.
<br>
2. We have been taking up the issues with AG and MD ECHS requesting them for streamlining the procedures to ensure minimum discomforts to the ECHS members in getting the required treatment. However, for the reasons best known to various authorities, these procedures have not been streamlined, which are causing a lot of inconvenience, discomforts, mental harassment, delays and too many rounds of ECHS-empanelled hospitals – approval authorities etc? Just to illustrate, the following example is given.

3. I developed some problem in my right eye. I went to ECHS Gurgaon and got reference to empanelled hospital which is Shroff Eye Centre (A renowned eye hospital). The eye specialist recommended some tests, for which I had to come back to ECHS Gurgaon the next day to get special referral for the tests, I then went back to Shroff hospital, the 3rd visit, where tests were carried out and ARMD was diagnosed in my right eye. The eye surgeon recommended that injection Avastin be given in my right eye for which I was to get back to ECHS Gurgaon to get Appendix ‘A’ signed. By then, four rounds had been made between ECHS Clinic & Shroff hospital and the treatment was yet to start. The OC ECHS Gurgaon who was new, was told by his staff that since the amount is more than Rs 5000/- the appendix ‘A’ is to be signed by SEMO Base Hospital Delhi Cantt. He sent the form to Base Hospital where the SEMO refused to sign since he wanted to see the patient. It is here; I got in touch with MD/Dy MD ECHS Delhi Cantt and asked them as to what was happening? Once a hospital has been empanelled after due checks on their capacities and abilities of being Super specialty hospital, the advice of the Eye surgeon for treatment must be honoured and the patient should not be made to run around just to do some administrative checks and audits. ECHS’s supervisory committees/teams should carry out these cheks and audit to ensure no malpractices are being carried out. The patient must not be made to run around. After a great amount of running around, the appendix A was signed and I was given the first dose of injection Avastin in my right eye. After a week I was required to be seen by the eyes Specialists. Again the same procedure was to be gone through (Another three rounds to get referrals). The eye specialist advised the second dose after four weeks and prescribed some medicines. These medicines were NA with ECHS and funds for local purchase were not available. I bought the medicines from the market. I had my 2nd injection thereafter, again four rounds I had to go through to get sanction for the 3rd and final dose of the injection which was required to save my right eye, even though partially. Sanction for the third appendix ‘A’ put me to extreme hardships. I had to get in touch with DGAFMS to seek his help. It took almost 15 days and finally Appendix ‘A’ was signed and my right eye received its 3rd dose of the injection on 21 June 2012.

4. I have narrated my own case to highlight that if this is what I had to go through, what about the jawan ESM? We had strongly suggested that single window super specialty medical care must be made available to ECHS members. The referral to the empanelled hospital should be for consultation, investigation treatment and follow up and there should be no need for the patient to run around to get administrative sanctions. Checks and audits may be introduced at the time of empanelling the hospital and subsequently by audit teams to ensure no malpractices are allowed to happen.

5. Some suggestions are made as under:-

(a) Emergency Cases: - ECHS members can be taken to any nearest hospital for emergency management. The Govt. while sanctioning License/ Registration to all hospitals should have a clause that defence personnel ECHS members are attended to in an emergency at the ECHS rates. The concerned hospital should inform the dependant ECHS Clinic/ECHS helpline about the patient. The designated team of doctors should visit the hospital within 24hrs to assess the condition of the patient.If the ECHS member who is admitted in an emergency, is in a state to be moved to an empanelled Hospital, the same may be carried out under ECHS arrangements. If he is not in a position to be moved out of the hospital, then he /she should continue to get treatment at the same hospital and the ECHS should make direct payment to the hospital at ECHS rates, The provision of the same should be incorporated in the terms and conditions of giving Licence to the hospital. If any extra charges are to be paid to the hospital, the same should be done by the ECHS and not the patient. The patient should not have to arrange and pay dues to the hospital. The case in point is of Brig Mahajan who was, in an emergency, taken to Madanta Gurgaon by his son & was kept in ICU for more than 15 days. His son had to raise private loans to pay bill of Rs 5,60,841.09 and only Rs 3,62,882/- have been reimbursed to him. He or his son is not in a position to bear the loan amount. The feelings expressed by Brig Mahajan in an attached mail will move any one; atleast, I had tears in my eye. As per terms and conditions of service, a soldier and his/her spouse are to be given free medical care for life. The ECHS scheme, in addition, provides for dependent parents and children.

(b) Normal Cases:- If it is not an emergency, the ECHS member should get referral to any empanelled hospital through any ECHS Polyclinic for consultation, investigation treatment and follow-up. ECHS doctors be kept informed by the ECHS member about his/her medical care once a month or as required. All bills be cleared by the ECHS and cheks and audits and any administrative sanction if required be carried out by the ECHS.
<br>
(c) MD ECHS should be the authority to operationalise the scheme. He can seek assistance of any military hospital nearby and other controlling authorities should be done away with.
<br>
(d) The budget provisions for the ECHS be made available in the beginning of the year. Additional projections may be made based on the requirement and sanctioned on Priority.
<br>
(e) The latest investigations and treatment techniques/facilities which have been introduced in the country within the last six months must absorbed by the ECHS empanelled hospitals. These should be updated every six months. There should be no need to get appendix A signed for any test/treatment already introduced and available in the empanelled hospital. It is intriguing as to why the injection Avastin which has been the treatment for more a decade in our country is not included in the ECHS Scheme.
<br>
(f) ECHS member should not have to spend money from his/her pocket to get any special consultation, investigation, treatment and follow up. ECHS should take care of the same.
<br>
(g) The facilities at RR, Base Hospital, Fd Hospital, or any other military medical establishment should be made available to the ECHS members who should have a choice to go to any one of these in addition to the empanelled hospitals
<br>
(h) AIIMS/Any other Govt hospital should also be available to ECHS member if they so choose to make use of it.
<br>
(j) Emoluments of polyclinic doctors and staff must be suitably enhanced to ensure that
they all are functional for a minimum of six hours and remaining 2 hours for administration purposes.
<br>
(k) Hospital bills must be cleared within 15 days as assured by MD ECHS to instill confidence in the empanelled hospitals to stay on and more good super specialty hospital to offer their services.
<br>
(l) Out sourcing of Pharmacy should be operationlised at the earliest.
<br>
6. The above are a few of the suggestions. More can be added/subtracted as deemed fit by MD ECHS, AG and the MoD.

Issues covered ensue.<br /><br /><br />OROP<br />He repeated the by-now-well-known government stand that OROP cannot be given in one go for fear of evoking a similar demand from civilian employees and that we are gradually moving towards narrowing the gap. I clarified that we have no objection to the term OROP being changed for record purposes by some other term like ‘military service pension’ as long the old and new pensioners are equated. I cited the example of the Military Service Pay that was granted exclusively for defence forces and there was not a whimper from others. <br /><br /><br />Widows’ Pension Enhancement<br />I stressed that after the Defence Minister confirmed over four months ago that he had cleared the proposal, the file is still on the bureaucratic circuit and that this does no good to the credibility of the high office. I gave my interpretation that it was part of the same Cabinet Secretary’s Committee report where the widows had been erroneously left out and hence it should not need any fresh financial approval. He said it would. I nudged him to take up the matter with the Finance Minister and he made a note.<br />The Defence Minister clarified that he has already had an official meeting with the three Services and that they would send a comprehensive proposal (including ESM problems). He would then take it personally to the PM soon after the Parliamentary session gets over on 20 May 2012. By that time the new budget would also be in effect. <br /><br /><br />Miscellaneous Points<br />Not unexpectedly, the discussion became wide ranging. Some points that could be of interest are:<br /><br /><br />• Reducing government doggedness in pursuing court cases involving serving personnel and the veterans that the government loses at lower courts. He reiterated his already having issued directions that each case be examined on merit. <br />• Need to control the bureaucracy that enjoys unbridled power with no accountability. They represent one of the many ESM organizations that exist in the country. However, being members of the same larger ESM community, their action will not be seen in isolation but will be construed as carrying the stamp of the entire ESM fraternity.<br /><br /><br />The intended action is apparently indicative of the frustration resulting out of the government apathy and continued stonewalling of our just demands. That frustration and anger is understandable. However, the pros and cons of the proposed ‘rail roko’ need to be analysed. Disrupting train traffic is not a novel idea in India. Nor does it prove any special skill or ability on our part as soldiers. It does not also indicate any gallantry. On the other hand, apart from being against the law, it would surely inconvenience the innocent passengers. This runs the risk of alienating the public that has been steadfastly supporting us and holds us in high affection and regard. <br /><br /><br />Often there is something to say for both sides of everything. Our colleagues who propose to undertake the disruptive action have the right to do what they want. However, since even those who do not subscribe to this form of methodology will be willy-nilly branded, there is a need to rethink. <br />In the larger interest of the community, I will urge all colleagues to desist from any action that is illegal and that may be considered anti national. Our struggle is only against the government that is denying us our just dues and not against our own country. We had got the issue raised in Parliament on 03 Mar 2010 and consequently the Govt sanctioned the already withheld approval to enhance pensions of JCOs and Jawans to correct old anomaly amounting to Rs 2200 croes on 08 Mar 2010. Hear again, the Govt did not enhance the pension of widows, the most needy segment of defence pensioners. This was not OROP. We have been relentlessly working hard to ask the Govt to grant OROP. We will succeed. Gist of discussion ensues.<br />OROP<br /> I made the following points:<br />· 1. OROP has been repeatedly recommended by Parliamentary Committees. These committees comprise elected members from different political parties. However, while rejecting these recommendations, the govt continues to stand by the report of the Cabinet Secretary’s Committee that had summarily rejected OROP without assigning any convincing reason. It leads to the unfortunate inference that the govt is being run not by the elected representatives but by the bureaucracy.<br /><br />· 2 The ESM as a community are apolitical and would prefer to remain so. However, with the continual rejection of OROP in the last three years, there is a strong chance that the ESM would be alienated from the Congress, more so since the main opposition party has openly declared that they would grant OROP if elected to power.<br /><br />· 3. Repeated rejection of this long pending demand might turn the disappointment of ESM into their frustration. It would be highly inadvisable to have a large section of society, who are trained in use of fire arms and explosives, frustrated. The govt should remain sensitive to this aspect.<br /><br />The Hon’ble Minister assured me that he is fully sympathetic to the demand of OROP but there are various factors that are coming in the way in granting it in one go and that the govt is moving towards this goal in stages. On being specifically asked whether they are working towards giving another enhancement, he answered in the affirmative. <br />Widows’ Pension Enhancement<br /> He himself stated that he was fully convinced that the demand was genuine and therefore had already got it cleared by the Defence Ministry. He told me that just prior to our meeting, he had called the Secretary ESW and had directed him to follow it up with other Ministries at the earliest. I asserted that I would check the progress in a fortnight’s time and if required meet him again; he was ok with it. <br />Miscellaneous<br />· On my raising the point that the govt continues to pursue legal cases till the last mile even though these have been rejected by the lower courts, the Minister stated that he has issued instructions to examine each case objectively. He further disclosed that he himself had directed against appealing in the pre-1973 Disabled Service Element case. I thanked him for it.<br /><br />· I stressed there are cases that have been decided by the apex court and the government is still not implementing those judgments. I cited concrete examples. He noted the point but there was no discussion on it. <br /><br />Concluding Remarks<br /> In normal conversation, the Minister made very laudatory remarks about the defence forces in general. He was particularly appreciative of the fact that Services were a large family and even after retirement veterans remained attached to this family. He displayed genuineness in his appreciation and did not seem to be making these comments just for the sake of form.<br /> <br />Other IESM News<br /> There continues a regular inflow of ESM telephone calls from across the country where they repose faith and confidence in the genuineness of IESM efforts. Enthusiasm is clearly discernible. Tomorrow (Feb 28), I am to participate in the programme of an education institute in Dundlot near Juhunjhunu in Rajasthan. It is not an ESM function. However, there have been a number of calls from that region in the last two days with ESM saying that they have read of it in the newspapers and they would want to participate.
