DEPOSITING OF MEDALS AND SUBMISSION OF MEMORANDUM SIGNED IN BLOOD BY THE ESM TO THE SUPREME COMMANDER
ON 22 AUG 2010 FROM 11 AM TO 3 PM
AT JANTAR MANTAR NEW DELHI
Dear Members of the Media,
1. The recent judgements of Supreme Court, High Courts and Armed Forces Tribunals (AFT) clearly reveal the grave injustices, apathetic attitude and arrogance of the Govt and the bureaucracy. Defence personnel, specially its veterans are feeling angry, hurt and aggrieved. All their efforts including peaceful protests have not moved the Govt which continues to deprive them of their legitimate demands. The fact that All Party Standing Committee on Defence, a most powerful committee of parliament after taking into consideration the reasons given by the Govt for not accepting their main demand of OROP has strongly recommended the grant of OROP to defence personnel holistically in its report tabled in the parliament on 07th May 2010 prove the genuineness of their demand.
2. Why the Govt is not looking after its Defence Forces who have been pillars of strength of our democracy? They have always demonstrated their patriotism, bravery, valour, courage and have in great measure assisted the country in strengthening its sovereignty and integrity. The unhappy Defence Forces specially its veterans, who have given their best years of life in the service of the nation, do not augur well for the country. Their status downgraded many times over, their JCOs (Naib Subedar, Subedar and Subedar Majors who are Gazetted officers are equated with non Gazetted civilians, their widows being left out from the recent small enhancement of pensions of JCOs and Jawan, no enhancements in pension to the aged and old reservists, senior officer, JCOs, Jawan getting less pension than their three to four rank juniors, the superannuated disabled old soldiers not being included in the policy of broad banding for Disability and War injury, the non grant of third Assured Career Progression (ACP) to the Sepoy, ACP award of 6th CPC not been notionally applied while fixing the pensions of pre 01 Jan 2006 retirees, the Govt not implementing the judgements of the courts. The list of grievances and injustices is too long and never ending. They feel cheated when they see their counter parts in the Civil services and police have been markedly put ahead of them. This is no way to treat the Defence Forces. Mostly the sons and wards to Defence veterans are serving in the Defence Forces. The ill treatment of their elders will certainly adversely affect their morale and motivation.
3. The Ex Servicemen from across the country through its ongoing movement, The Indian Ex Servicemen Movement (IESM) have decided to intensify their stir. They have once again decided to deposit their medals and present memorandum signed in Blood to their Supreme Commander on 22 Aug 2010 at 3 PM. The medals collection and signing of memorandum in Blood will be carried out at Jantar Mantar New Delhi from 11 AM to 2 PM. The representatives of veterans from across the country will bring along with them the medals and the blood signatures of veterans from their areas.
4. The Chairman of IESM Lt Gen Raj Kadyan has once again appealed to the Supreme Commander to kindly accept the medals and memorandum signed in Blood herself. In his letter to the President, he has written, quote “It is earnestly hoped that the Supreme Commander would relent and receive the delegation in person. However, should that unfortunately not happen, as already intimated vide ibid letter dated 08 June 2010, the delegation would return without depositing the medals and the memorandum” unquote.
5. The IESM requests our media to kindly pay its positive role to project the true facts of the issues of Defence Forces. We therefore, request you to kindly carry this news in your paper/magazine/TV Channels and give it the widest publicity. The people of India have the right to know why the Defence Forces are feeling hurt and anguished.
6. You are also invited in strength to cover the event of Medal Deposit and signing of memorandum in Blood on 22 Aug 2010 at 11 AM to 2 PM at Jantar Mantar New Delhi. The delegation of IESM will leave for Rashtrapati Bhawan at 2.15 PM to deposit the medals and present the memorandum to the President. You are requested to cover the event at Rashtrapati Bhawan at 3 PM. This time the delegation will be led by the Chairman Gen Raj Kadyan himself along with Vice Chairman Maj Gen Satbir Singh, SM and others.

Bala, Satbir, Aditya Jaini, Kameshwar Pandey, Krit Joshipura and self attended an ESM rally in village Silani, Jhajjar District of Haryana Aug 14. It was basically a ‘thanks giving’ rally as termed by the organizers CPO Dharam Pal and Capt JS Rathi. Attendance was over 500 with some 75 Service families. In their brief speeches the hosts thanked the IESM for their continued efforts in seeking amelioration of various ESM problems.
There were demands for opening more ECHS policlinics in different towns. The ESM also want a greater spread of CSD outlets so that they do not have to travel far to purchase stores. The gathering was apprised of the govt negative response on extending the recent pension enhancement benefits to Service widows. There was unanimous lament and condemnation of the govt apathy. They were assured that the IESM will keep pursuing this point.

IESM CORE GROUP MEETING AT 1030H TO 1530H ON SATURDAY 25 SEP 2010 AT AVCC NOIDA
Dear members of the core group IESM
IESM core group meeting pan India is planned to be held at 1030h on 25 sep 2010 Saturday at AVCC Sector - 37 Noida. All the members are requested to attend the meeting .
Members are requested to forward their points to be included in agenda points. Agenda points for the meeting will be issued later.
It is proposed to reimburse the travel fare for travel of all the members of core group arriving for the meeting. Members can choose the most convenient mode of travel to reach the venue but the reimbursement will be restricted to actual fare or AC 3 tier whichever is less. Please do bring the receipts of your travel expenses.
All members, who are attending, are requested to kindly bring the photocopy of their tickets/receipts or send the photocopy of the ticket in advance so that the expenses can be reimbursed during the meeting. This is an audit requirement and we would not be able reimburse the cost without proper photocopy of the ticket/receipt.

DEPOSITING OF MEDALS AND SUBMISSION OF MEMORANDUM SIGNED IN BLOOD BY THE ESM TO THE SUPREME COMMANDER ON 22 AUG 2010 FROM

Dear Friends,
1. The gross injustice, apathy negative attitude and indifference of the Govt and the bureaucracy have crossed all levels of tolerance and acceptance. There are two options, one, to accept the status quo, live the life as it unfolds and melt away. The second option is to get up and fight for Justice. As a soldier, the have learnt to follow the second option.
2. I wish to quote a few instances of Govt apathy and injustices:-
(a) All Party parliamentary Committee is supposed to be one of the most powerful committee. This committee headed by a congress MP Shri Satpal Ji Maharaj while tabling its report in the Parliament on 07 May 2010 had recommended the grant of OROP to the Defence Personnel. Three months have passed, the Govt has not taken the decision on this recommendation. Why the Govt has kept this committee report under the carpet is not understood? This was the chance before the Govt to undo the damage already inflicted on Defence Forces.
(b) The Govt has not implemented any of the judgements recently passed favouring the Defence Personnel:-
(i) SC judgement in Rank Pay case. Instead of accepting its fault and implementing the judgement, it has appealed to the SC to recall its orders.
(ii) In the case of pre 96 Maj Gens (Maj Gen Vains Vs Union of India), the Govt continues to ignore the implementation of judgement fully. Instead of giving the same pensions to similarly placed pre 96 Maj Gen as per Para 31 of the SC judgement, it has fixed arbitrarily the pension of pre 96 Maj Gen by increasing it by Rs 500 pm ie Rs 10000/-instead of Rs 11450 being given to similarly placed post 96 Maj Gens.
(iii) In the case of Pre 2006 Maj Gen, the Govt has not implemented the judgement of AFT Chandigarh dated 03 Mar 2010 where in the Govt was to implement the judgement within 3 months. The execution proceedings have been filed by the Maj Gens and the hearing is on the 10 Aug 2010.
(iv) In the case of Babu Ram Dhiman and Sohan Singh Vs Union of India, AFT Chandigarh judgement on OROP dated 08 Mar 2010 which was to be implemented within 4 months, has not been implemented.
(c) The widows of JCOs and Jawans who need the maximum assistance, care and compassion have been left out from the recent enhancement in pension of JCOs and Jawans. Here, also instead of giving the enhancement with effect from 01 Jan 2006, it has been sanctioned with effect from 01 Jul 2009.
(d) The 6th Pay Commission had granted three Assured Career Progressions (ACP). Strangely the ACP has not been applied notionally while fixing the pensions of Pre 01 Jan 2006 retirees. Even for Post 01 Jan 2006 retiree defence personnel, only two ACPs have been granted. Why the third has not been granted to a Sepoy who has been compulsorily retired from service after 17 years of service?
(e) There is a large gap of Rs 11600 in pension of pre 2006 retiree Maj and Lt Col while the gap in their pay in the 5th Pay Commission was only Rs 1000/-. Similarly the pension gap between pre 2006 retiree Maj Gen and Lt Gen is Rs 9800/- while the difference in their pay prior to 2006 was only Rs 1200. Why this grave injustice?
(f) The President has not granted the audience to the delegation of IESM depositing medals with the President.
3. The Govt indifferent attitude has irked the veterans severely who have decided to intensify the stir. The next event for deposit of medals and submission of Blood Signed Memorandum to the Supreme Commander will be held on 22 Aug 2010 at Jantar Mantar New Delhi from 11 AM to 2 PM. IESM delegation will leave for Rashtrapati Bhawan at 2.15 PM to deposit the medals and memorandum at 3 PM to the President. Chairman IESM Gen Raj Kadyan has written to the President quote “It is earnestly hoped that the Supreme Commander would relent and receive the delegation in person. However, should that unfortunately not happen, as already intimated vide ibid letter dated 08 June 2010, the delegation would return without depositing the medals and the memorandum” unquote
4. All conveners are requested to put in their best effort to motivate the ESM across the country to deposit their medals and sign /thumb impression the memorandum in Blood voluntarily for the above event. These can either be sent to IESM HQ at 543 Sector 23 Gurgaon (Hr).- 122017 or brought to Jantar mantar on 22 Aug 2010 by 11 AM. Conveners are requested to get maximum ESM at Jantar Mantar. Part payment of transport charges will be made from the IESM funds, Tea, water and lunch packets are being arranged for the ESM attending the event.
5. Logistic Instructions for the event will be issued by the General Secretary separately.
6. We are also, putting efforts to get support from all segments of society including all political parties, MPs, MLAs, CMs.
7. Please circulate this mail to maximum ESM across the country.

join in the efforts to get Justice to the Defence Forces”.

OROP as explained by Brig CS Kamboj

Some of you may not be familiar about the two ways of defining the OROP (there may be even more than two ways of defining it if you were to take into account all the emails that have been floating on the net in last two years).
The two definitions which are more prevalent and being debated are –
1. Option 1. Same Rank – same total length of service – same pension.
2. Option 2. Same Rank – same length of service in that rank – same pension.
The option two has the following disadvantages –
1. Complete old service records of every ESM have to be dug-up to establish how many years one spent in his last rank.

Therefore, every CDA authority will vehemently oppose the second option (if OROP is agreed to).

Option 2 is simply an ego driven option.
It is ego of some which is creating more and more splinter groups among ESM.
Therefore, it will be in general interest to majority of ESM that we accept the definition as per Option 1 above.

Last year I had received very large number of emails from some of the Selection Grade Lt Cols and equivalents as to why the Time Scale Lt Cols and equivalents are being given the same pension as the Selection Grade. Gradually they all reconciled to the situation and hopefully you all will also reconcile to Option 1 of the OROP definition.
Please do not create further splinter groups among the ESM.

Some of you may not be familiar about the two ways of defining the OROP (there may be even more than two ways of defining it if you were to take into account all the emails that have been floating on the net in last two years).
The two definitions which are more prevalent and being debated are –
1. Option 1. Same Rank – same total length of service – same pension.
2. Option 2. Same Rank – same length of service in that rank – same pension.
The option two has the following disadvantages –
1. Complete old service records of every ESM have to be dug-up to establish how many years one spent in his last rank.

Dear Colleagues,
I had been in North East of India and have been off the net since 21 July 2010. The Governing body met from 1000 hours to 1300 hours today. It was attended by Satbir, Vinod Gandhi, Krit Joshipura, Aditya Jaini, CK Sharma, Sharan Ahuja, Rakesh Chaturvedi, and self. Decisions taken on various points will be communicated separately.
Some colleagues have (again) suggested that OROP should be based on length of service in the rank at retirement and not total service as the IESM have been consistently projecting. Their view is fully respected. However, we need to remember that we have to go for a formula that benefits the maximum. Over 97% of the ESM are JCOs and OR for whom we are fighting. Unlike the officers (who retire by age) they all retire by service. For them ‘service in the rank at retirement’ has no relevance. For example, a Subedar superannuating after 28 years of service must get the same pension as any other Subedar with similar service. His service in the rank of Subedar varies not only from Regiment to Regiment but also from battalion to battalion within the same Regiment. In fact in fixed class composition battalions, since promotion prospects vary, the difference may even lie – and often does – from one class to another. Therefore, applying the criterion of ‘service in the rank at retirement’ will be highly discriminatory. All this had been taken into account when pursuit of OROP commenced in April 2008.
Among officers there may be some individuals who will stand to gain or lose from one criterion or the other. It will not be advisable to give an officer-orientation to OROP as a concept. Majority gain must remain our focus.
A related point is the use of terminology of OROP. There has been a well-reasoned suggestion that we should replace the term with some other, such as complete or total parity, military pension or the like. This might be in the hope (perhaps vain) that the government would be more receptive to the new term. I would recommend that we retain OROP as it has become a psychological magnet and a rallying point for ESM and any change might be misconstrued to imply that we have diluted our stand and have betrayed the ESM. OROP has also become known in the society.
